Color me surprised! Looks like Minneapolis’ first Somali-American police officer is also the first Somali-American police officer to be charged with manslaughter. I wonder what the evidence was the Minnesota Bureau of Criminal Apprehension uncovered that led District Attorney Freeman to edict Officer Noor? Will this go to trial or will Noor be allowed to cop a guilty plea to a lesser offense? Manslaughter would appear to be the appropriate charge. Given the scenario as described in the news it does appears that Officer Noor panicked and acted recklessly rather than out of malice. A plea bargain is likely since DA ‘s seldom want to take case to trial unless they believe they have a slam dunk conviction. Also as a practical matter plea bargains generally save the county a lot of money by avoiding the cost of a full blown trial and at the same time effectively remove the miscreant from the community for however long his sentence is. Given that it took the MBCA so long to conclude it’s investigation the evidence they found against Noor may be largely circumstantial and as such there could be all kinds of reasonable doubt in the case, enough to confound a jury. As they say, the general rule of trial strategy if you are the defendant is that if your case hangs on the evidence, then ask for a jury trial, whereas if your case hangs on a point of law, then go with a bench trail and ask for the judge to decide your case.
