Man Arrested After Shooting Home Invaders in Minnesota, Killing One
An illustrative case study. Bob Owens brings up a good point. You can’t reasonably claim you were in fear for your life if you are inside your house and the intruder is still outside. You have to wait until the intruder breaks in and enters your dwelling before you can claim you were reasonably in fear for your life. If you go outside to confront an intruder that could be interpreted by a court as having gone looking for a fight. Best to call 911 and let the cops apprehend the intruder, unless someone’s life is in danger. Minnesota doesn’t have a castle doctrine law, but the existing self-defense laws in the state are close enough as to make little difference. In Minnesota it is also permissible to use deadly force to prevent the commission of a “felony”, so that actually gives one more leeway in using force to prevent the loss of valuable property than in most other parts of the country.
